According to this source, Archibald KIRKLAND was listed in tax lists in Anderson County, TN (1805) and Bledsoe County, TN (1815), and in the Circuit Court Minute Book, case #210, Knox County, TN (1810). Records show him in Cotaco [later Morgan] County, AL in 1818 and 1819. He and his brother, Daniel, settled west of Hartsille in Morgan County, AL on Flint Creek about 1817-8 after floating down the Tennessee River on a raft from Sequatchie Valley, Marion County, TN. Archibald moved from Morgan County to Fayette County, AL by 1830. He was a farmer, cattleman, slave holder and Primitive Baptist.

      (5) An order of the Probate Court of Fayette County, AL, entered during the November Term, 1851, in the matter of the estate of Archibald KIRKLAND, deceased, is quoted in its entirety by Patricia A. West in ?One Line of Descent from Archibald Kirkland, b ca 1780 SC & d 1846 AL,? St. Louis: Unpublished manuscript, 2006.

      That order provided that equal shares of Archibald's estatate would be distributed to the following persons: (1) Archibald's daughter, Elizabeth (KIRKLAND) MOORE; (2) Archibald's son, John KIRKLAND; (3) Anderson FARQUHAR, the husband of Archibald's daughter, Lavina (KIRKLAND) MOORE; (4) Archibald's son, Jehu KIRKLAND; (5) Archibald's son, Daniel KIRKLAND; (6) William MOORE, the husband of Archibald's daughter, Mary (KIRKLAND) MOORE; (7) Archibald's son, Robert KIRKLAND; and (8) Archibald's son, William KIRKLAND.

      That order also provided that the share of Archibald's estate which would have been distributed to his then deceased daughter, Virginia Jane (KIRKLAND) MANASCO, if she had then been living would be distributed to the following persons: (1) Virginia Jane's son, Archibald MANASCO; (2) Ambrose ALDRIDGE, the husband of Virginia Jane's daughter, Mary MANASCO; (3) Virginia Jane's daughter, Priscilla MANASCO; (4) Virginia Jane's son, John MANASCO; (5) Virginia Jane's son, Carroll MANASCO; and (6) Virginia Jane's daughter, Letetia MANASCO.

      [Note by compiler: It should be noted that property which was distributed from Archibald's estate for the benefit of married women was distributed to their husbands.

      The following is a brief explanation of the property rights of a married woman at common law.

      At common law, a single woman had the legal capacity to make contracts, to hold property and to sue or be sued. However, a married woman was not regarded as a legal person.

      At common law, a married woman could not generally contract with either her husband or third persons, and she could not generally sue or be sued unless she was joined with her husband.

      At common law, a husband was entitled during the marriage to the rents and profits from any real property to which his wife held the fee-simple title, and if any issue were born alive of the marriage, he acquired a tenancy by curtesy, which gave him the rents and profits from such property during his lifetime. On his death his wife or her heirs took such property. If such property was sold by the wife and her husband, the proceeds of the sale became his, like the rest of her personal property. The husband also became seized of any real property in which the wife held a life estate, and was entitled to the rents and profits from that property for the duration of the life estate. The corresponding entitlement for the wife was her dower interest in her husband's real property. Dower gave the wife a life estate in one-third of the real property to which her husband held the fee-simple title at any time during their marriage, and upon his death his estate was liable for her dower interest.

      At common law, a wife's personal property (except for items such as clothing and jewelry) became the property of her husband upon marriage, and on his death it passed to his personal representative. This also was true as to personal property which she acquired during the marriage. If her husband predeceased her, however, the property was returned to her.]
