JONE BATTEN. * * * THOMAS SMOOT, son and probably eldest child of William Smooth, Sr., and Grace, widow of _____ Wood, was born about 1634, probably in York County, Virginia. He was among the children named by his father as having been brought by him to Maryland in 1646. . . His marriage to Jone Batten must have occurred about 1661. The will of William Batten of St. Mary's Co., dated May 29, 1662, mentions his wife Margery, sister JONE SMUTE, and WILLIAM SMUTE, son of said sister, residue of estate. Overseers: Capt. Josias Fendall, Robert Henly, brother-in-law THOS. SMUTE. (Baldwin, Maryland Wills, 1:22.) In 1664 Thomas Smoote caused a writ to be issued against Margery Batten, administratrix of William Batten, for debt. The "Petition of Thomas Smoote Sheweth That Margery Batten Executrix of her late Deceased husband William Batten hath not as yet payed unto yor Petr the Legacy by the aforesd Willm Batten Deceased gytten unto the Wife and Child of yor Petr. wherefore yor Petr humbly Craueth this honble Court tht they will bee pleased & Graunt him an Order agst the aforesd Margery Batten for the legacy as aforesd gyuen by Willm Batten aforesd. (Lib. B. B., Folio 261, Md. Archives, 49:165.) On 9 Feb. 1663-4 the Cause was retracted. . . . Children of Thomas Smoot, Sr., and Jone Batten i. William, probably born abt 1662; deeded land in 1684 and 1692, with his wife Anne. It is not clear whether he left descendants, and if he moved to another county. . . . [Note by compiler: A similarly described William SMOOT, who was married to a woman named Anne, is listed by this author as a son of Richard SMOOT.] ii. THOMAS, JR., probably born about 1663; will dated 6 Jan., 1704, proved 30 Jan., 1704/5; md. (? Ann) Barton. There is no direct record statement that he is a son of Thomas Smoot, Sr., but since he was not a son of Richard Smoot, the other son of William Smoot, the emigrant, he must have been a son of Thomas. The above account of the latter's estate calls for the "remainder to be equally divided between his children." The language here indicates two children.
