      (2) John HAILE, Sr. was a son and heir of Capt. Richard HAILE, as is evidenced by the deed abstracted below in Fleet, Beverley, Essex County Records, 1703-1706, Baltimore, MD: Genealogical Publishing Co., 1961, p. 6:

      [Essex County, VA Wills and Deeds, 1702-1704] page 29. Deed. 10 July 1703. The entry opens with "To all Exparince popell to whom these Presents shall com I John Haille of the County of Essex son and hare of Cap't Richard Haille Deceased send greeting". After that he sells to John Loveing, for 2000 lb tobo, 100 acres in King and Queen Co., being part of a greater tract granted "to my Father Captt Richard Haill" lying part in King and Queen Co. and part in Essex Co. Boundries begin "at a marked Whight oak standing upon a branch side that Iesweth out of Bevarley run that cometh out of Mattaponey river", adjoins "portobago path", etc.

      [Note by compiler: Under the law of primogeniture in effect in VA at the time of Capt. Richard HAILE's death, a father's eldest living son inherited all of the father's real property if the father died intestate; however, if the father died testate, the provisions of the father's will governed. It appears from the wording of the deed abstracted above that Capt. Richard HAILE died intestate, and that John HAILE, Sr. was Richard's eldest son living at the time of Richard's death.]

      Will of John Haile of the County of Essex and parish of Southfarnham, dated 17 Aug. 1744.

      Unto my well beloved wife the use of all my real and personal estate during her life or widowhood and after the decease of my wife or at the day of her second marriage to be equally divided amongst my six children now liveing, Francis Haile, John Haile, Thomas Haile, Benjamin Haile, and Mary Edmondson, Susanna Allen.

      My well beloved wife and my beloved son John Haile executors.
