      Your petitioner Franklin Hale a resident of the County of White and State of Illinois humbly complaining would respectfully represent with your Honor that heretofore towit on [?] the 29th day of September A.D. 1860 one Asa Hale of said county died intestate leaving at the time of his death a widow towit Elizabeth Hale who died on the ___ day of ___ 1860 and your Petitioner Franklin Hale, Samuel Hale & Sarah Ann Hale[,] who intermarried with one Washington G. Hale[,] his children[,] and Mary [who intermarried with one John B. Carter] Hale[,] Martha Hale[,] Lafayette Hale[,] Emily Hale[,] Sarah J. Hale[,] children of William Hale deceased[,] and grand children of the said Asa Hale,s [?] his heirs at law, All of whom are prayed to be made Defendants hereto. That the above named Mary [illegible Leander] Hale[,] Martha Hale[,] Lafayette Hale[,] Emily Hale and Sarah J. Hale are minor [sic] for whom your Petitioner prays a Guardian ad litem may be appointed.

      Your Petitioner would further represent unto your Honor that the said Asa Hale was seized in fee simple of the following described real estate situate in the County of White and State of Illinois towit The North West fourth of the North East quarter of Section 1 and Part of the North East fourth of the Nortwest quarter of Section One, all in Township Seven South Range Eight East, Said last described land being more particularly described by metes and bounds in the office of the Recorder of White County Illinois in Book "L" page 527 as follows: [illegible] Beginning at the NE cornder of the NE qr of the NW qr of Sec 1 T 7 8 E at a stake[,] thence S 136 E, 71 poles to stake[,] thence South 87° & 30' West 33 poles & 21 links to a stake, thence N 30° W, 11 poles to a stake, thence on the Township line, thence North 89½° E 33 poles & 21 links to the beginning.

      Your Petitioner would further represent unto your Honor that for the above named Defendants as heirs at law of the above named Asa Hale deceased are entiled [sic] in fee simple to the above described premises as follows towit:

      To your Petitioner Franklin Hale one fourth part of the same in fee simple, to Samuel Hale one fourth part of the same in fee simple, to Sarah wife of Washington G. Hale, one fourth part of the same in fee simple, and to Mary Carter, Martha Hale, Lafayette Hale[,] Emily Hale, and Sarah J. Hale[,] children of William Hale, each one fifth of one fourth of the same in fee simple.

      Therefore in consideration of the premises and inasmuch as your Petitioner can have adequate relieve [sic] save [?] in this Court where matters of this kind are properly cognizable he would pray that upon a final hearing herein, that your Honor would decree partition of said lnads among said parties in interest according to there [sic] respective rights. And to the End that the same may be done, your Petitioner would humbly pray thaat three discreet [sic] persons be appointed commissioners herein to make such partition. That they be directed to set apart and allot to the said parties by metes and bounds according to their respective interests as aforesaid, having due reference to both quality and quantity, if the same can be done without manifest prejudice to said estate. That said commisioner [sic] be requested to report their proceedings to this Court [illegible].

      May it please your Honor to grant to your Petitioner the Peoples writ of summons to be directed to said defendants & commanding them to [sic] and may it please your Honor to grant to your Petitioner such other relief as may be right and equitable and to good concience [sic] and Equity belong, and your Petitioner as in duty [illegible] willing pray &c [?].
