11-2-1799 - Petition of inhabitants of Davidson Co for a "firm and lasting Bridge" be built "over the Lick branch adjoining the Town of Nashville." They state that "frequent applications have been made to the County Court to lay a tax for such an expense", but they have refused to act . . . the public road from Wainsborough crosses the Cumberland River at Barrows Ferry and also the Waggon road from Abies ferry to Nashville, come together below the Lick branch, crosses it at its junction with the Cumberland River where the banks are at least 150 feet high and is impassable at all times for carriages and, with the depth of the water eight months of the year, for foot and horse men . . . a Bridge of 150 or 200 feet in length would be beneficial to all. Petitioners ask that a law be passed making it the duty of the Justices to lay a tax. Signed by: . . .

(2) Close, H. E., The Family of Cleveland Eldred Shook, Derby, NY: H. E. Close, 1968, pp. IV-B-(3) to IV-B-(9):

WILLIAM HALE - born in 1777 probably in Bedford County, Virginia. Moved with his parents as a child to Davidson County, Tennessee. Married Sally Brown on 18 or 21 March, 1799 in Davidson Co. Sally was born in 1778 in North Carolina (the area we know as Tennessee belonged to North Carolina until 1796 when it became the 16th state). It appears that William took his family into central Illinois, possibly Sangamon Co., about 1820 and furthur [sic] on into the Hamilton's Diggins (Fort Hamilton or Wiota), Iowa Co, Michigan Territory in the summer of 1828. Sally and the Hale girls were the first white women at the "Diggins". With the shortage of women, it didn't take long to marry off the eligible daughters.

William and Sally are shown in the 1830 Census as follows:

For many years during the research for the family history, it appeared that William Hale died sometime after the 1830 Census because no trace could be found about him after that date. There was also an old family story that there was a monument honoring the Shook family at Correctionville, Iowa. This monument, it turned out did not exist, but accidently we discovered there was a monument, not in Correctionville, Iowa, but near the village of Kent, Illinois, honoring men who were killed in the Black Hawk War in 1832. William Hale's name appears on this monument and the story of his death makes an interesting tale. . . .

THE DEATH OF WILLIAM HALE

In April, 1832 the famous Indian Chief, Black Hawk of the Sauk tribe, led his followers back across the Mississippi River to their old tribal lands. What started as a protest erupted into a full fledged war with the call-up of the Illinois Militia on 16 April, 1832. The frontier flammed [sic] with terror and the settlers "forted up" at the nearest settlements. The Shooks and Hales moved to Fort Hamilton (present day Wiota) where the women and children would be safe. The armed men went out to the farms each day to care for their stock and crops.

On the 23rd of May, 1832, we find William Hale at the village of Dixon's Ferry. Along with William were Aaron Hawley, Aquilla Floyd, Alexander Higginbotham, John Fowler (husband of Amelia Hale, William's daughter), and Thomas Kenney. We know Kenney had been on a cattle buying trip in southern Illinois, and assume William and the others had been with him. When the fighting broke out, they left the herd in Sangamon County and hurried home. When the six men left Dixon's Ferry they were accompanied by Felix St. Vrain, the Sauk Indian Agent, who was carrying dispatches from General Atkinson for the garrison at Galena. The hostiles had cut off Galena from the main body of Militia at Dixon's after they had routed the Militia at Stillman's Run.

The mounted party of seven moved cautiously to Buffalo Grove where they buried the body of William Durley who had been ambushed and killed on the 19th. After the burial, the party moved about 10-15 miles on toward home where they camped for the night. Their supper was eaten cold for they could not risk the danger of alerting the Indians with a fire.

Moving out of their camp at daybreak on the 24th, they moved onward a few miles and stopped for breakfast. After they had finished, the journey was started again. They had ridden about a mile when they suddenly encountered a party of about 30 Indians. St. Vrain told the other men that they had nothing to fear for he knew some of the Indians and saw that the party contained a number of Winnebago Indians who were supposedly friendly. St. Vrain rode forward to talk to the Indians with his hand outstretched in friendly greeting. The gesture of peace and friendship was spurned and after a short discussion it was obvious that past friendships would mean nothing. At a signal, the seven settlers spured [sic] their horses and dashed away.

With a few scattered rifle shots and a chorus of yells the Indians dashed after their prey. The race with death was on!

The Indians rode along a ridge over which the road crossed. Floyd and Higginbotham beat the Indians to the pass, but St. Vrain, Hale, Fowler and Hawley were forced off the road toward marshy low ground. St. Vrain was shot through the back of the neck, cried out, and fell from his horse. Hawley, alone, fled toward Yellow Creek and was lost from sight.

William Hale and his son-in-law, John Fowler, moved off in the direction of Rush Creek. Their horses soon tired from running in the mire and the Indians closed with them. In a final spatter of gunfire and flash of knives the two white men died.

Thomas Kenney, the seventh member of the party, saw John Fowler fall from his horse and saw William Hale's horse dart away without its rider. Kenney joined Floyd and Higginbotham, and fled into the brush. After several more pursuits by the hostiles, the three men hid by day and traveling by night reached Galena early in the morning of the 26th of May. One of their horses dropping dead from exhaustion at the outskirts of the town.

On the 8th of June, a party of mounted riflemen under the command of Colonel Henry Dodge and Captain Stephenson were guided to the site of the fight by Alexander Higginbotham, one of the survivors. The bodies of Hale, Fowler and St. Vrain were found where they had fallen, about four miles south of Kellogg's Grove. According to the June 13th issue of the Galenian,

"- The head of St. Vrain was cut entirely off, and taken away, as were also his feet and hands. - A son and son-in-law of Mr. Hale were present when their mangled father was buried. Grief was plainly depicted on their faces. Thirty dollars in specie, was found in the pocket of Mr. Hale, which, together with his pocket book, was covered with blood."

Hale and Fowler had both been scalped and were buried with St. Vrain where they had fallen. Aaron Hawley's body was never recovered, but there is no doubt that he had been killed. In Black Hawk's autobiography he mentions the taking of Durley's scalp (on the 19th)and the taking of four more four days later by Winnebagoes. One of the last four belonged to St. Vrain.

In July, 1832, Illinois Militia units under the command of General Posey were dispatched to the vicinity of Fort Hamilton to help protect the settlers who were "forted up" there. The discipline of these troops was quite lax, and combined with almost no system to keep them supplied, the militiamen were often left on their own to obtain food for themselves and their horses. After the war was over there were many claims made against the government for damages caused by the foraging troops. The following claims were are signed on the 8th of March, 1833 in Jo Daviess County, Illinois, all signed in support of each others claim and all stated that they were near neighbors.

• Elias Shook - paid $260 for 70 bu of wheat, 240 bu of oats, 100 bu of potatoes, and damages to his house and garden.

• Stephen G. Hale - paid $140 for 6 acres of wheat and damages to his vegatable [sic] garden.

• Sarah Hale (widow of William) - through Robert Campbell as her agent, was paid $106 for 2 acres (40 bu) of wheat, 50 bu of potatoes, her vegatable [sic] garden, 70 chickens, a stand of bees, and two hogs.

Nicholas L. Hale, who was evidently living with Stephen Hale, supported these claims. In all cases the militia men took down the fences and turned their horses in the fields of growing grain when the settlers were absent in Fort Hamilton. These claims are on Roll 56 of Microcopy 574 of claims from the Black Hawk War on file in the National Archives.

The June 6th issue of the Galenian describes William Hale as formerly of Sangamon Co., Illinois, settling at Wiota in 1828, as "an old man who had fought many battles during a previous Indian War when our country called for his services. His conduct then did honor to his name. He has left a large and helpless family on our frontier to lament his loss." Sally, or Sarah, his widow, appears in the 1838 Census of Iowa County with 5 in her family. In 1850 she was living with the family of Russell Fulp in Lafayette County and is shown as "Sally Hale," age 72, born in North Carolina. She died sometime after 1850, but her date and place of death and burial has not been found.

In 1886 the bodies of the men killed in the vicinity of Kellogg's Grove were reburied on a wooded hilltop about a mile from the present village of Kent, Illinois. The main monument lists the names of 23 men killed at the Battle of Kellogg's Grove on the 25th of June, 1832 under the command of Col John Dement. One of the names listed is "William Hale, Private". On a smaller marker nearby is shown the name "Felix St. Vrain, May 22, 1832", and next to it is another marked "William Hale, 1st Sgt, Iowa Mounted Volunteers". There are evidently a few mix-ups here:

First: - there were not 23 men killed in this vicinity during the whole war. Some may be those who died of disease or other causes.

Second: - Felix St. Vrain was killed on the 24th of May, not the 22nd.

Third: - William Hale is listed in the National Archives as the 1st Sgt of Capt Price's Company, Iowa Mounted Volunteers, mustered into service on 20th of May, 1832 and discharged on the 20th of August 1832, serving 3 months. Obviously Capt Price did not keep very good records of his men; his 1st Sgt was dead 4 days after the Company was mustered. William was probably a member of the militia, and when the War started the existing roster was submitted as those called Into service whether they were present or not.

THE CHILDREN OF WILLIAM HALE AND SALLY BROWN

Note that members of this family married into the Wright, Corwin, and Shook family - some of them are cousins several times over. Also note that several of these familys moved to Dakota County, Nebraska about the same time that Elias and Sarah Shook moved there.

1. STEVEN GIBSON HALE - b c1800 in Tenn. Married twice; 1st wife was Tobathia Fowler, 2nd wife was Mary Diana Wright (1829-1907) whom he married in 1849 in Dane Co., Wisc. (. . . , a niece of Bezallel Wright). Lived in, and shown in the Census of Iowa Co. in 1830 and 1836. Moved to Primrose Township, Dane Co., Wisc. with his brother, Washington Hale in 1848, and is shown there in the 1850 Census. About 1860 he moved to Omadi Precinct, Dakota Co., Nebraska and is shown there in the 1870 Census. Died some time after May, 1874. . . .

2. NICHOLAS HALE - m (?) Eliza Fossett 16 Oct 1823 by W. Russell, JP in Davidson Co., Tenn. Listed in the 1836 Census of Iowa Co., Wisc., District #7.

3. AMELIA J. HALE - b c1802 in Tennessee, m John H. Fowler on 4 Sep 1823 by W. Russell JP in Davidson Co., Tenn. John was supposedly a native of Virginia and was an Ensign of the 20th Regt Sangamon Co., Ill. Militia in 1821. John was the son-in-law of William Hale and died with him on the 24th of May, 1832.

4. MAHALA HALE - b 1803-1805 in Tennessee, m Robert Campbell in the fall of 1828 - the first wedding in Wiota. Lived in the Blue Mounds area in the 1838 Census with 7 in the family. Their son, William, is said to be the first white child born of resident parents in the area of Wiota Township. William was born in the fall of 1829 and died in the winter of 1831. He is buried ¼ mile southwest of Wiota.

5. SARAH HALE - b c1809 in Tennessee, m Elias Shook c1829. d after 1881 in Omadi Precinct, Dakota Co., Nebr. . . .

8. ELDRED SYLVESTER HALE - b 19 Apr 1816 in Tennessee, m Mary Jones on 27 May 1849. Mary was b c1832 in England. Eldred is listed as a member of the Fort Hamilton garrison in 1832. We find the family listed in the 1846 Census of Iowa Co. and in the 1850 Census of Primrose Twp, Dane Co., Wisc. . . .

9. CHARLES JACKSON HALE - b c1818 in Tennessee. Listed in the 1840 Census of Iowa Co. as 20-30 years old and a farmer. He was a member of the Wiota Militia and was listed in both the Early and the Late 1847 Census of Lafayette Co. In the 1850 Census of Lafayette Co. he is living with John F. Brown (age 30 b Kentucky) and his wife, Mary Brown (age 22 b Tenn).

10. JOHN W. HALE - b c1814. Lived at Mineral Point or Dodgeville and supposedly went to California about 1849 in the gold rush.

11. NARCISSA HALE - b 24 Aug 1820. m Reuben Bennett Short. Listed in the 1840 and 1847 census of Iowa Co., Wisc., and in the 1850 Census of Dane Co., Wisc. . . .

Arabella Goulding married Jonathan Brewer, son of John Brewer and Elizabeth Rice, circa 1715; marriage not recorded in Billerica, Boston, Bridgewater, Cambridge, Chelmsford, Concord, Dedham, Framingham, Groton, Lancaster, Marlborough, Natick, Newton, Sherborn, Stow, or Sudbury. Arabella Goulding died after 1737 in Framingham, MA; her name not recorded in Framingham, Middlesex Co, MA VRs.

She and Jonathan Brewer covenanted to the church on 17 April 1717 in Framingham, MA. An administrator was appointed in 1774 for the estate of an Arabella Brewer of Framingham. Could this be the same person?

Along with his debts were 3 cows and calves, 2 large wagons, his saddle, 2 yards of broad cloth and a fine hat to be put up for sale.

• According to Howard County Heritage, 1873 - 1988, Howard County Heritage Club, 1988, p. 155: "The [AUSTIN] ancestors . . . were from Scotland. They moved to the area of Leeds [Yorkshire], England. Then came to Mississippi. . . ." [The compiler has not verified that information.]

• Leroy was the head of a household in Jefferson County, AL at the time of the 1840 census.

Listed in Leroy's household are 2 free white males under 5 years of age; 1 free white male between 20 and 30 years of age; and 1 free white female between 20 and 30 years of age.

Assuming that Leroy is the free white male listed in the 1840 census as then being between 20 and 30 years of age, he would have been born between 1810 and 1820, according to the 1840 census.

Assuming that Leroy's wife is the free white female listed in the 1840 census as then being between 20 and 30 years of age, she would have been born between 1810 and 1820, according to the 1840 census.

Assuming that the other persons in Leroy's household are children of Leroy and/or his wife, those children would have consisted of two sons (both of which sons would have been born between 1835 and 1840, according to the 1840 census).

BIOGRAPHY: "Descendants of James Davis, 1762-1831, White County, Tennessee, Pioneer" by Larry Craig Boyd, Sparta, TN. Nathaniel Glen had a large beautiful farm and a handsome two-story home in Lost Creek community. In a house down in the south field of that farm, his granddaughter, Mary Attie Austin Anderson, was born in March of 1884. Nathaniel Glen signed a note for one of his brother-in-laws, and, when the fellow did not pay the debt, N. G. had to sell his farm to settle the affair. He and Jane moved 6 miles north of Sparta to Yankeetown, where a married daughter (Darthula Austin White) lived.

BIOGRAPHY: By John Robert (Bob) Austin: "Rollin and Mary Ann lived in the vicinity of Greene and White County Tennessee until the later part of the eighteen forties. After their death and burial of their second child William Austin in the Austin Cemetery (On Nathaniel's Farm) they took the rest of their family and left this part of the county and headed north into Arkansas. I don't know just how long they were on this trip only that they were in Blythe Township in Marion County Arkansas before the 1860 censuses Then later moved into Boone County just South of Lead Hill Arkansas. On the 5th day of October 1886 he and his wife Mary Ann deeded their farm to one of their sons Obidiah Austin in exchange for room and keep until their deaths and were to receive a proper burial."

BIOGRAPHY-DEATH: "Heritage of White County, TN, 1806-1999", Walsworth Publishing Company, p 209. Roberson was a tall erect man with a long white beard; by nature he was very gentle and kind, gifted with the ability to make things with wood and iron.

During the Civil War he made heavy duty wagons for the Army. When about 80 years old he made a loom on which to make carpeting. On 5 February 1912, he died of pneumonia at the home of Ann (Austin) Gleason, his daughter. Roberson donated the land for the 1st church built at Lost Creek - to be used jointly to hold services for the Missionary Baptist, Methodist and Presbyterian Churches, as well as the public school.

Pleasant Austin, a prosperous agriculturist of the Second District, was born September 8, 1820, on the farm upon which he now resides. His parents were John and Catherine (Haston) Austin. The father [John AUSTIN] was born January 6, 1779, in Virginia, of English origin. He immigrated to Tennessee at a very early day, where he died February 28, 1858. The mother [Catherine HASTON] is thought to have been of Dutch descent. She was a native of Tennessee and her entire life was passed in the State.

On 17 Apr 1841, John was appointed postmaster of the Austinville postoffice near the present Mooresville-Monroe Twp. line. John died on 18 May 1849, per this source, of cholera enroute to the California gold fields. His Will was written on 12 May 1849, and probated on 20 June 1849. It was witnessed by Reuben McCoskrie, who himself reportedly died of cholera 4 days later.

LAND: In the Shoal Creek/Utica/Austinville region of Livingston County, MO the inter-related families of Andrew Bryan (father of Mary and Margaret who marr White Co., TN Austins), James L. The mother is thought to have been of Dutch descent. She was a native of Tennessee and her entire life was passed in the State. Our subject was brought up on the farm, and educated in the school of the vicinity. After attaining his majority he purchased land in the county and farmed about six years. At his father's death he bought the homestead and moved to it, where he has since resided. He is a substantial, honorable and worthy citizen. He is interested in the advancement of education and all beneficial enterprises. He is a Democrat. RESIDENCE: In the Wythe Co., VA Tax Book, Bartholomew was taxed in 1793.

CENSUS-CHILDREN: It would appear from the 1820 US Census for Ashe Co., NC that all 13 of Bartholomew's and Anna's children were still at home, but the census form listed two age groups in which one duplicated that already listed (i.e. the 16-18 age group is a duplication of those in the 16-26 age group - this occurring only when males between the ages of 16-18 were in the household). The 1820 census, p 3 read as follows: Bat Auston, 3 males under 10 years; 3 males 10-16 years; 1 male 16-18 (this one would also be included in the following age group): 3 males 16-26; 1 male over 45; 1 female under 10 years old; 1 female 10-16; 1 female 10-16; 1 female 16-25 and 1 female over 45 years old. The son that had already left home by the 1820 census was probably William or Isaiah. Jesse and Andrew both married after the 1820 census.

DEATH: Bartholomew Austin died around 1841 at Cumberland Gap, KY, en-route to/or from visiting relatives in KY. The source for Bartholomew's death was word of mouth conversation between E. Ray Austin, Ruth Marshall Austin, and Ann Dawson Thomas, of Amelia, VA, in the late 1980's or early 1990's. This information was passed on to Ann previously, but she doesn't remember her source. NOTE: Anna Reeves was listed as a widow in the 1850 US Census (see above), so Bartholomew obviously died before 8 Oct 1850. ACTION: Death date & place must be verified.

BIOGRAPHY: In a ca. 1934 article published in "The Southside Virginian", Vol. VI, #28, Jun 1983 issue, Norton, VA, on p 55, David Washington Austin (Jesse's son) related the story of his family's travels: Two years after leaving Grayson Co., VA for Ashe Co., NC, the Jesse Austin family were ready to move on to newer country. On 15 Nov 1855, Jesse Austin gathered together his family and all his earthly possessions and made ready to head for the mountains of Kentucky. There were 29 in the company, 12 in Jesse Austin's family, 12 in John Poplin's family, Jim Ashly, Abe Gooch, Enoch Cox, Jess Parsons, and Bets Howell. They had 5 wagons pulled by 2 yokes of oxen and 3 teams of horses. The also had two other horses and five head of cattle, four milk cows and one heifer. They drove through Washington Co., VA near Iron Mountain and into Wise Co., VA where Jesse Austin met one of his mother's cousins Terrial Cox, who had come to that part of the country some time before. Cox persuaded Jesse and his family to remain with him until Spring. This was on 20 Dec 1855. So they rented a little house and lived in Wise Co., VA until March of 1856 when they moved to Elkhorn Creek on the same bottoms where Mudtown is now. They lived there until the outbreak of the Civil War, 1861, and then moved back to Wise Co., VA. They settled in the south of the mountain in what is now called White Oak. There they pioneered in a woodland that Jesse had purchased previously.

RESIDENCE-LOCALE: "Family Burying Grounds of Wise Co., VA" by James Taylor Adams, Southwest Virginian, Norton, VA ( no year, but probably the late 1930's) . "The settlement around the forks of The Pound, now generally known as Austin's Store, was called Donkey in the olden days and was a rendezvous for bad men. I have heard old citizens say that around 1900 the place bore such an evil reputation that travelers on the old Pound Gap Turnpike (now US 23) would go out of their way and around it. One day, eleven years ago, One-Eyed Dock Mullins told me in Austin Store, in the presense of George Fields Austin, that he had compiled a list of 51 killings that had occurred within a radius of four miles of where he stood.".
