      7. ANN FROST, dau. of ISAIAH and Sarah, b. ca. 1827-8 Luzerne Twp. PA, d. after 1848. . . . She is alleged to have m. a William MILLER, but we have no documented follow up proof.

      8. HENRY FROST, s. of ISAIAH and Sarah, b. ca. 1830 Luzerne Twp PA, d. unk. According to family legend, Henry left family sometime between NOV 1864 and MAY 1865 and went west. Allegation has been made that he deserted family to avoid civil war service; however examination of conscription records for Fayette Co. does not reveal his name. Shortly after his 3rd son was born, wife received a letter stating he would not be back whereupon his wife is alleged to have abruptly died. We wonder how much of this tale is fact or fiction. Research into St.Louis MO. city directories (where he was supposed to have gone) does show a Henry Frost or Ffrost residing at various locations in St.Louis in 1869-1870-1873. Another allegation is that he changed his name and remarried - again no real evidence. . . . The will of ISAIAH Sr., father of Henry, mentions that he was to be penalized for "misbehavior" of an undisclosed nature - much speculation has surrounded this clause. We have given up hope of ever solving this riddle. . . . .

      ABSTRACT

      Know all men by these presents that I, ISAIAH FROST Sr. of Luzerne Township, Fayette County and State of PA., considering the uncertainty of this life, and being of sound and disposing mind and memory, and being desirous of settling and disposing of my worldly concerns while I have the strength and capacity so to do, do ordain and publish this my last will and testament in manner and form as follows, viz.

      - stating in considerable detail each child mentioned is to receive 1/8 share of coal interest in all the lands he holds title to in Maryland and Pennsylvania; each to have at least a quarter acre of Coal at each pit with access to without hindrance, and erecting houses thereon;

      - 1/8 share of the stock in Mineral Bank at Cumberland;

      - 1/8 share of canal stock;

      - 1/8 share of Railroad stock;

      - 1/8 share all coal lands in PA. and MD.;

      - 1/8 share of his colored people in Maryland;

      - 1/8 share in all my personal property;

      in addition -

      Item 1. to son JOHN FROST, the 2 quarter sections of land (300 acres) on which he now lives in KNOX Co. OHIO.

      Item 2. to daughter ELIZABETH MERRILL, the farm on which she now lives in Greene County PA. containing 185 acres.

      Item 3. to daughter SARAH ANDERSON the tract of land on which she now lives in Maryland containing 114 acres, except for 1/5 acre which is the Railroad interest.

      Item 4. to daughter SUSAN TODD my Brightwell and Havely properties except 5 acres for the use of the Mill property.

      Item 5. to my son ISAIAH FROST Jr. 200 acres of my Homestead farm upon which I now reside, it being the northern part of said farm and to include my present home mansion and bequeaths his 8 day clock to Isaiah Jr.

      Item 6. to my daughter HARRIET FROST the one undivided half of Tilghman tract of land in MD.

      Item 7. to daughter ANN FROST the other undivided half of Tilghman tract in MD.

      Item 8. to my son HENRY FROST the residue of my homestead farm including the place I bought of Jacob FOGLE, adjoining the lands of Jesse ANTRAM, William HAZEL and C. BREADING to be divided from my son ISAIAH's part by a line beginning at the lower corner of my said land on the Monongahela river, adjoining Jesse Antram's lot of land on which Jonathan CHRISTOPHER now lives, thence up the hill to hickory corner, thence to the corner of the Gum spring field including all of that field along the fence of same line lately run by F. LEWIS to a sugar tree corner, at the corner of that lot of coal land I lately sold to C. BREADING, thence to that lot at the birch tree on corner of said Breading's farm.

      Item 9. My Jacob RUSH farm containing 217 acres and a piece of land I own on Dan Mountain containing about 5 acres to all my heirs in equal shares. And they may sell their respective shares to all my heirs in equal shares, but not to any other person or persons until the expiration of 20 years, at which time they may sell the whole of said property and divide proceeds equally among themselves or their heirs.

      Item 10. to my wife Sarah FROST, a comfortable maintenance and support on my homestead farm where she now lives, and continue to reside there during her natural life or widowhood.

      Item 11. it is my will and desire that in case any of my heirs or their representatives shall be likely to squander or run through any part of my estate bequeathed in this will, it shall be the duty of my executors to take the said property out of their possession, hold an inquest of three disinterested men, upon the same to appraise the rent of it, and rent it to some good person.

      Item 12. it is my will and desire that my colored people in Maryland shall not be sold but that my executors shall choose three reputable disinterested citizens of the neighborhood to set a value upon each and all of them and then divide them among themselves in equal parts and in case they cannot be divided equally, my heirs to pay each other what shall make it equal according to the value or appraisement put upon said colored persons, but they are not to be sold out of the family, but to be divided in the above described manner, equally among all my heirs.

      Item 13. it is my will and intention that in case of the death of any of my heirs, the whole and all property which I have bequeathed to them in this will shall descend immediately to their heirs provided they are my grandchildren (if legitimate) and if any of my heirs named in this will should die without legitimate issue, then their all I have bequeathed to them in this will shall fall back to the rest of my heirs in equal shares amongst them immediately after such death, and it is my full intention and meaning that all property and bequests left in this will to my several heirs shall be held and owned by each of them for their own separate use and sole and entire interest with free access to use and make uses of the same without restriction let or hindrance to each other.

      Item 14. I hereby ordain and decree to my two sons ISAIAH and HENRY unrestricted one with the other, the use of the following pieces of Timber land, each to take and use the timber of the same for their own separate use to wit: the flat piece of timberland on the south side of Patterson Run on the hill, also the flat piece of timberland below the Fogle Lot to the coal mine, and also the piece of timberland up the river above the coal mine next (to) Breading's fence to the field that lays next to the country road, each to use timber off the same while it lasts, but to all other timberlands, each shall be confined to his own side of said run, and to the timber only on the above described pieces of land to them and their heirs or assigns.

      Item 15. It is my will and intention that any of my heirs living in PA. or OH. is not to hold any right to any land upon which the coal lays which I have given them and interest in except the lot aforementioned at each pit, and the right to get coal to the above mentioned amount of 1/8 th part. This is my full intention and meaning among all my heirs.

      Item 16. it is my will and desire that should any dispute or disagreement arise among my heirs respecting any gift or bequest made in this my last will and testament, that all parties interested shall choose amicably 2 or 3 disinterested reputable men to settle said dispute, and not to go into any court to commence any suits or suits at law.

      Item 17. I hereby ordain and appoint by son ISAIAH FROST executor of this my last will and testament, and it shall be the privilege of a majority of my heirs to select any other suitable person to serve with him in the capacity of executor. Given my hand and seal the ninth day of October 1847.

      CODICIL (Dated 9 NOV. 1848)

      And as my youngest son HENRY FROST has been disobedient, and has left me at or about the age of eighteen years old, I must in equal right and equity charge him with $150 per year for the space of 3 years, which will make $450, and which is to be paid in 3 years, and that money applied to my just debts through the hands of my executors. I also add that the (bill ?) and debt that NICHOLAS MERRILL may yet owe must be paid in one year from this date, debt and interest, and it also to be applied to my just debts through the hands of my executors, and I also add that all of the rents now due from my children shall be paid in as fast as possible to my executors to applied to my just debts through the hands of my executors. I also add that my son ISAIAH FROST shall pay the sum of $1000 out of his estate, as his part in consideration is worth more than any other portions, and that money is to be applied to my just debts through the hands of my executors. I also again remember my wife SARAH FROST that is in this way, that she may have choice of her house where she may wish and the above or in the will names heirs to keep her comfortable and to provide for all she may need as before said, while she may live or during her widowhood. I also add that all my lots in the town of Frostburgh, are to be sold to the best and highest markets and the money thereof to be applied to my just debts, through the hands of my executors. Given under my hand and seal this ninth day of NOV.1848

      On this 18th day of November 1848, came ISAIAH FROST Jr. and made oath on the Holy Evangely of Almighty God that the written instrument of writing is the true and whole will and testament and codicil of ISAIAH FROST Sr., late of Fayette Co. PA., deceased, that hath come into his hands or possession, and that he doth not know of any other. (Test. W.R.McCulley?register)

      On the 22nd day of November 1848 came William FEAR, Peter BAKER, Elijah FULLER, Thomas W. WRIGHT and Thomas HEALEY the subscribing witnesses to the within last will and testament and codicil of ISAIAH FROST Sr. late of Fayette Co. PA. deceased and severally made oath on the Holy Evangely of the Almighty God that they did see the testator therein named sign and seal the codicil and republish his signature to said will, and that they heard him publish, pronounce and declare the same to be his last will and testament and codicil and that the time of his doing he was to the best of their apprehension of sound and disposing mind, memory and understanding, and that they respectively subscribed their names as witnesses to this will and codicil in the presence and at the request of the testator, and all in the presence of each other.       I certify the foregoing is a true copy from the original will and codicil of ISAIAH FROST Sr., late of Fayette Co.       EDITOR NOTE. This is an extremely complex document. The copies filed in Fayette and Greene counties PA. are identical to those filed in Cumberland, Allegany Co. MD.

      Subject will, when studied carefully, appears to be begging for trouble with its restrictive covenants, etc. We sense an underlying parental control that is just a bit too strict, and dictates from the grave that which may have existed in life. To a degree this is borne out by 3 letters from nephew Enoch to his father Josiah Jr. in Knox Co. OH. of April 6 1846, Oct.11 1848, telling of the trouble, trial and problems in the trial; establishing certain property survey points in Frostburg, etc. He is requesting his father to come to Frostburg at once and give evidence. Later in August 21 1851 Enoch to his father, relates that David ANDERSON (husband of Sarah Frost Anderson) has broken the will of Isaiah and is determined to collect rents from the time of Isaiah's death. The outcome of this effort is uncertain. There is much more to this story buried n the court records of Frostburg and would make a very interesting story for one who might have time and patience to dig it all out.

      (2) A household headed by Isaah FROST is listed in the 1810 census of District 4, Allegany County, MD.

      Listed in Isaah's household are 1 free white male under 10 years of age; 1 free white male between 26 and 45 years of age; 1 free white female under 10 years of age; and 1 free white female between 16 and 26 years of age.

      Assuming that Isaah is the free white male listed in the 1810 census as then being between 26 and 45 years of age, he would have been born between 1765 and 1784, according to the 1810 census.

      Assuming that Isaah's wife is the free white female listed in the 1810 census as then being between 16 and 26 years of age, she would have been born between 1784 and 1794, according to the 1810 census.

      Assuming that the other persons in Isaah's household are children of Isaah and/or his wife, those children would have consisted of one son (which son would have been born between 1800 and 1810, according to the 1810 census) and one daughter (which daughter would have been born between 1800 and 1810, according to the 1810 census).

      (2) A household headed by Isaiah FROST is listed in the 1820 census of Election District 5, Allegany County, MD.

      Listed in Isaiah's household are 2 free white males under 10 years of age; 1 free white male between 10 and 16 years of age; 1 free white male between 26 and 45 years of age; 4 free white females under 10 years of age; and 1 free white female between 26 and 45 years of age.

      Assuming that Isaiah is the free white male listed in the 1820 census as then being between 26 and 45 years of age, he would have been born between 1775 and 1794, according to the 1820 census.

      Assuming that Isaiah's wife is the free white female listed in the 1820 census as then being between 26 and 45 years of age, she would have been born between 1775 and 1794, according to the 1820 census.

      Assuming that the other persons in Isaiah's household are children of Isaiah and/or his wife, those children would have consisted of 3 sons (2 of which sons would have been born between 1810 and 1820, and 1 of which sons would have been born between 1804 and 1810, according to the 1820 census) and 4 daughters (which daughters would have been born between 1810 and 1820, according to the 1820 census).

      (3) Scharf, J. Thomas, History of Western Maryland, Vol. II, Philadelphia, PA: Louis H. Everts, 1882, p. 1354:

      The following were the judges of the several election districts of the county for 1829, appointed by the Levy Court: . . .

      No. 5 - Isaiah Frost, John Combs, Samuel Mattingly.

      (4) The compiler has not found a listing of a household headed by Isaiah FROST in the 1830 census.

      (5) A household headed by Isaiah FROAT is listed in the 1840 census of Luzerne Township, Fayette County, PA. [The compiler believes that Isaiah's surname was really FROST.]

      Listed in Isaiah's household are 1 free white male between 10 and 15 years of age; 1 free white male between 15 and 20 years of age; 1 free white male between 60 and 70 years of age; 1 free white female between 10 and 15 years of age; 1 free white female between 15 and 20 years of age; and 1 free white female between 40 and 50 years of age. Also listed with Isaiah is 1 free colored male.

      Assuming that Isaiah is the free white male listed in the 1840 census as then being between 60 and 70 years of age, he would have been born between 1770 and 1780, according to the 1840 census.

      Assuming that Isaiah's wife is the free white female listed in the 1840 census as then being between 40 and 50 years of age, she would have been born between 1790 and 1800, according to the 1840 census.
