      James MARCHANT [Jr.], Miller of Westerham, married Elizabeth FRANCIS on 4 February 1802; some of the FRANCIS family were Gentry. His Will was proved on 24 April 1806. Both his children were daughters, Elizabeth MARCHANT and Mary Ann MARCHANT; and the latter was to die in January 1821 aged 16 years.

      This is the last Will and Testament of me James Marchant the Younger of Westerham in the County of Kent Miller ffirst as to all and every or any Messuages Lands Tenements hereditaments and real Estate whatsoever and wheresoever that I die _____ possessed of interested in or intitled to disposed of I give and devise the same to my Wife Elizabeth Marchant and her Assigns for and during the time of her natural Life And from and after her decease unto my two Children Elizabeth and Mary Ann their respective heirs and Assigns for ever as Tenants in common and not as join Tenants Also I give and bequeath unto my said Wife Elizabeth Marchant and my ffriend William Smith of Casham [?] in the Parish of Westerham aforesaid the Sum of five hundred pounds five per cent Navy Annuities of the Bank of England now standing in my Name In Trust for my said Wife to receive and take the Yearly Interest of dividends and produce thereof for and towards the support and Maintenance of herself and my said two Children Elizabeth and Mary Ann until they shall respectively attain the Age of twenty one Years And as and when they shall respectively attain the said Age to pay and transfer to each of them One equal Moiety or half part thereof but in Case either of my said Children shall die under the said Age of Twenty one Years and without lawful Issue Then to pay and transfer the whole of the said Sum to the Survivor of them at the Age of twenty One years but in case either or both of my said Children so dying shall have lawful Issue such Issue to take same Also I give and bequeath to the said William Smith the Sum of Ten Pounds over and above his proper Costs and Charges in and concerning the due performance of this my Will Also I give and bequeath to my said Wife the full and free use and Enjoyment of all and singular my Household Goods Plate Linen and Woollen for and during the term of her natural Life And from and after her decease the same to go to my said Children or the Survivor of them or their lawful Issue as aforesaid And as to all my Stock in Trade ready Money and Securities for Money And all the rest and Residue of my Personal Estate and Effects whatsoever and wheresoever (after Payment of all my just debts ffuneral Expences and the Charges of proving this my Will and other incidental Costs and Charges in and concerning the due performance thereof) I give and bequeath the same to my said Wife Elizabeth Marchant and the said William Smith In Trust to be converted into Money as soon as conveniently may be after my decease And the amount or produce thereof to be laid out and vested in the purchase of Stock or Annuities in one of the Public ffunds of the Bank of England in the Names of the said Trustees for my said Wife to receive and take the Yearly Interest or dividends thereof for and during the Term of her natural Life for and towards the Maintenance and support of herself and also of my said Children as long as they shall remain unmarried And from and immediately after her decease the principal Stock or Annuities so purchased to go and be transferred and divided in two equal parts or Shares unto and between my said two Children or their surviving lawful Issue respectively And for want of such Issue then the whole of the said Principal Stock or Annuities to go to the Survivor of them or her lawful Representatives And I do make constitute and appoint my said Wife Elizabeth Marchant and the said William Smith joint Executors of this my Will and Guardians of my said Children And I do hereby revoke and make void all other Wills by me at any time heretofore made In Witness whereof I the said James Marchant the Testator have hereunto set my Hand and Seal the ninth day of November in the Year of our Lord one thousand eight hundred and five.
