      Born about 1837 in Georgia and of Buck Branch, Clarke, Georgia in 1850 the son of John HAILES and Mary _____. [Note by compiler: John T. HALE's mother was a woman whose name is unknown to the compiler.]

      I, John T. Hale, being of sound and disposing mind and memory, do make declare and publish this my last Will and testament in terms following to wit: -

      Item 1st. It is my will and desire that my Executrix hereinafter named shall as soon as practicable after my death pay all debts, in which I may at that time be justly bound using for this purpose any cash on hand or deposit, not necessary for the immediate use of my family, and if there should not be sufficient funds for this purpose, then I direct that such of my property as she may deem for the best interest of my estate be sold and the proceeds be used as set fourth as above.

      Item II. It is my will, that my estate at my death shall remain as it is, as long as my wife shall live, and that my wife and daughter Ada Noell, shall have a support out of the income from my estate as long as my wife Mary A. Hale, shall live and remain a widow.

      Item III. I direct that my daughter Ada Noell shall have a support from the income of my estate so long as she remains in her present widowhood, and the estate remains undivided as provided for in item 7th of this will.

      Item 4. I direct that, that portion of my lands on the north side of Ellsbury creek, be controlled and managed for the maintenance and support of my wife Mary A. Hale, and my daughter Ada Noell, and that, that portion of my land on the south side of said creek be rented to the best advantage possible, and should the rents or income from the land on the north side of said creek not be sufficient of my wife and daughter above set forth, they shall have whatever is necessary from the rents or income of the said South of my place to afford them a decent support, and should there be a surplus from the rents or income of said southside of my place, said surplus shall be equally divided between my four children Edward T.[,] Oscar L.[,] Obediah Hale, and Ada Noell.

      Item 5th. I direct that should I die before my son Obed D. Hale reaches his majority, he shall have from my estate, the sum of Seventy five dollars, which amount is necessary to put him into an equal footing with my other children for advances already made them.

      Item 6. It is my will and desire, that all perishable property on my place at the time of my death not needed to carry on the farm, shall be sold, and the proceeds there from be equally divided between my four children as set forth above.

      Item 7th. It is my will and desire, that at the death of my wife, my entire estate shall be equally divided between my four children E. T. Hale, Oscar L. Hale, Obed D. Hale and Ada Noell, or their heirs at law.

      Item 8th. I direct that no timber shall be cut from my place so long as it remains undivided except for the use of my place.

      Item 9th. It is my will, that the lower pasture shall be used for the benefit of that portion of my place on the south side of Ellsbury creek where my son Oscar now lives.

      Item 10th. It is my will and desire, that my sons, Oscar L. & Obed D., shall have the option until they are twenty seven years of age of renting any portion of my place, by paying a rental of one fourth of the yield of whatever land they may cultivate, should my wife live until they should reach this age.

      Item 11. I appoint my beloved wife Mary A. Hale, to execute the terms of this Will, and direct that she shall be released from making any bond or security as such Executrix.

      In testimony whereof I have hereunto set my hand and affixed my seal, this 24th day of January 1899.

      Before me came W. C. Baugh named as a witness to the within writing purporting to be John T. Hales last Will and being duly saith, that he with J. T. Pittard, and R. T. Pittard at the request of said John T. Hale, and in his presence, and in the presence of each other, did attest as witnesses the within writing as his last Will, that he was at the time of said attestation and signing by him of sound and disposing mind and memory, that he executed the within paper voluntarily.

      The above petition of Mary A. Hale, nominated Executrix of the last alleged Will of John T. Hale, duly filed, having been supported by proper proof of W. C. Baugh, a witness to said Will, that said John T. Hale died a resident of said County, that he, and the other witnesses, J. T. Pittard and R. T. Pittard, saw him sign and heard him publish, the alleged will as his own last Will, that he attested the same as a witness at his request and in his presence, with J. T. Pittard and R. T. Pittard, so attesting also at his request, that said John T. Hale was at the time of said signing and attestation of sound and disposing mind and memory, and did in the execution of said Will act freely and voluntarily. It is ordered that the same be duly recorded, having been duly proved in Common form, and that letters testamentary issue to her upon the taking the usual oath of office.

      Suggestion: Oglethorpe Echo - April 21, 1899 - Last Monday morning Mr. John T. Hale, after several months sickness, breathed his last. Tuesday a large assembly of kindred and friends met and Rev. W.M. Coile, assisted by Rev. L.P. Winter spoke fittingly of the life and Christian character of this good man. After these enlogies loving hands tenderly laid him down to rest near the home where he had so long lived. Mr. Hale was sixty years old and for about thirteen had been an humble disciple of the Master. He died in the fellowship of Winterville Baptist Church.
