      This is the last Will & Testament of me William Marchant of Boar place in the parish of Chiddingstone in the County of Kent Yeoman ffirst and principally I commend my Soul into the hands of Almighty God my Creator and my Body I commit to the Earth to be decently buried at the discretion of my Executors hereinafter named and my worldly Estate I dispose of as follows (that is to say) in the first place I direct that all my just debts ffuneral Testamentary and other Expences shall be paid and satisfied and I give and devise unto my two Sons William Marchant and John Marchant their heirs and assigns all that my ffarm and Lands with the Barn Buildings rights _____ Heredits and appurts thereto belonging containing by estimation fforty one acres be the same more or less situate lying and being in the parish of Hawkhurst in the said County of Kent in the occupation of Richard Ellis or his _____ and all other my Real Estate whatsoever and wheresoever unto and to the use of my said two Sons William Marchant and John Marchant and of their heirs and assigns for ever upon trust nevertheless that they the said William Marchant and John Marchant of the Survivor of them or the heirs or assigns of the Survivor do and shall with all convenient speed after my decease sell and dispose of the said ffarm Lands Heredits and Real Estate whether by public or private Sale for the most money that can reasonably be obtained for the same and for that purpose make and execute all such agreements deeds and conveyances as shall be necessary to effectuate such Sale or Sales And I do hereby declare my will to be that the receipt or receipts of my said Trustees or of the Survivor of the two his heirs or assigns shall be a sufficient discharge and sufficient discharges to any purchaser or purchasers of my Real Estate or any part thereof his her Heirs Executors or admors for the purchase or consideration money expressed and acknowledged by such receipt or receipts to be received and that such purchaser or purchasers his her or their Heirs Executors or admors shall not afterwards be responsible for the misapplication or nonapplication of such purchase money and it is my further will and intention and so I do hereby declare that the money to arise from the Sale of my said ffarm Lands and Real Estate shall fall into and become part of my personal Estate and be disposed of therewith by my Trustees and Executors in manner hereinafter mentioned and I give and bequeath unto my said Sons William Marchant and John Marchant the Sum of one thousand pounds of lawful English money upon trust to place the same out at Interest on _____ or Government Securities in their names and vary the Securities on which the same shall be so placed out as often as they shall think profit and upon trust to pay to or otherwise permit and suffer my wife Ann Marchant to have receive and take the Interest and proceeds of the said Sum of one thousand pounds during her natural life if she shall so long maintain educate and provide for John Marchant the natural Son of my daughter Jane and it is my express will that my said wife shall maintain educate and support my said Grandson John Marchant so long as she receives the Interest of the said Sum of one thousand pounds which Interest is to commence and be payable from the day of my decease and from and immediately after the death of my said wife upon trust that my said Trustees shall and do pay the Sum of Three hundred and Eighty pounds unto my said Grandson John Marchant and divide and distribute the residue of the said principal Sum of one thousand pounds unto and equally amongst all my children (vizt) William Robert Mary John Richard Jane and Jesse Also I give and bequeath unto my said wife Ann all the ffurniture of the parlores and of the Chamber over the Kitchen with the Bed and Bedstead in the same Chamber and the Linen usually kept there and it is also my wish that my Sons Robert and John shall permit my wife to have her board and Lodging and residence in the house I now inhabit so long as they continue to occupy the same without paying any compensation for such Board and Lodging nevertheless in case of any disagreement between my Sons Robert and John and my said wife it is not my intention that my said Sons shall be compelled to suffer my wife to reside there or to furnish her with board and Lodging but I cause this to be inserted in will as my recommendation only and it is my will that the provision hereinbefore made for my said wife shall be accepted by her not only in full discharge of all her dower widow right and claim in and to my real and personal Estate but also in full discharge and satisfaction of a certain Bond or obligation under my hand and Seal having date the Eleventh day of April one thousand Seven hundred and Eighty nine made previous to and in consideration of my Marriage with my sd wife And I order that my said wife shall release her dower and all claim to my Real and personal Estate and deliver up the said Bond to my Executors to be cancelled within one month after my decease and in case she shall refuse so to do then I do hereby revoke every Bequest and provision herein made to or for her and declare that she shall in such event take nothing under or by virtue of this my Will Also I give and bequeath unto the said John Marchant the illegitimate child of my said daughter Jane the Sum of Three hundred and Eighty pounds of lawful English Money to be paid to him by my Trustees out of the before mentioned Sum of One thousand pounds immediately after the decease of my said wife or as soon as the same can be called in and received with Interest for the same after the rate of ffive pounds per centum per annum from the day of my wife's decease but in case my said Grandson John Marchant shall not have attained the age of Twenty years at the time at the time of my wife's death my said Trustees shall then pay and apply the Interest of the said Sum of Three hundred and eighty pounds for and towards his maintenance and Education until he shall have attained that age when he shall be entitled to receive the principal and whereas I have already advanced to or for the benefit of my said Daughter Mary the Sum of three hundred pounds & to or for the benefit of my said Son William the Sum of Two hundred and Eighteen pounds and to or for the benefit of my said Son Robert one hundred and Nineteen pounds now therefore in order that may be equally distributed amongst all my children I do hereby give and bequeath unto my said Son William the further Sum of Eighty two pounds of lawful English money and unto my said Son Robert the Sum of one hundred and Eighty one pounds and unto my Sons John Richard and Jesse and unto my Daughter Jane the Sum of Three Hundred pounds apiece of like lawful Money Also said Legacies to be paid within twelve months from the day of my decease with Interest for the same in the mean time and it is my will that my two Sons Robert and Jesse shall succeed me in all my ffarms and ffarming Business if my Landlord will accept them as his Tenants and that they shall take all the Stock crops and Effects of every description in about and belonging to my said ffarms if they think proper to continue the Business at a fair valuation and appraisement to be made according to the Custom of the Country by two persons one to be chosen by my said Sons Robert and Jesse and the other by their Brothers and Sisters and in case the said two persons shall not agree then the valuation to be made by such third man as they shall appoint as umpire whose determination shall be conclusive and I do hereby declare that the amount of such valuation shall be paid or accounted for by my said Sons Robert and Jesse and shall be considered as part of my personal Estate and be disposed of therewith as hereinafter is mentioned and I do hereby give and bequeath all the rest residue and remainder of my Monies and Securities for Money Mortgages Bonds Bills Notes Books debts Goods Chattels Effects and personal Estate whatsoever and wheresoever of what nature kind or quality soever unto my said Seven Children William Robert Mary John Richard Jane and Jesse to be equally divided between them share and share alike And lastly I do hereby constitute and appoint my said Sons William and Jesse joint Executors of this my Will and I declare that they shall not be responsible for the acts or deeds of each other nor for any loss which may happen to the said Trust Estate or Effects unless it shall happen by their own wilful neglect or default And hereby revoking all other Wills I declare this only to be my last Will and Testament In witness whereof I the said William Marchant the Testator have to this my Will contained in four sheets of paper set my hand and Seal that is to say to the first three Sheets thereof my hand and to this fourth and last sheet my hand and Seal this Nineteenth day
